Standard Terms and Conditions

Effective Date: February 2026

Scope of Services
Aegiros Cargo Surveyors Inc. (“Aegiros”) provides marine and cargo survey, inspection, reporting and related advisory services only as specifically instructed by the client.

Standard of Care
Services are performed with reasonable skill and care consistent with normal practice for independent marine surveyors. No warranty or guarantee is given that any condition, defect, damage or irregularity will necessarily be identified.

Reliance on Information
Aegiros is entitled to rely on documents, statements, records, measurements and information supplied by others unless expressly retained to verify them independently.

Nature of Report
Any report or certificate represents Aegiros’ findings and opinions only as at the date and time of attendance and only on the basis of the conditions observed and information made available at that time.

Use of Report
Reports are prepared solely for the instructing client in connection with the specific matter instructed and may not be relied upon by any third party without Aegiros’ prior written consent.

No Consequential Loss
Aegiros shall not be liable for any indirect, incidental, special, punitive or consequential loss, including loss of profit, loss of market, loss of use, delay, demurrage or business interruption.

Liability Cap
To the fullest extent permitted by law, the total aggregate liability of Aegiros, whether in contract, tort, negligence or otherwise, arising out of or in connection with the services or any report shall not exceed the greater of the fee charged for the particular assignment or CAD 25,000, subject always to a maximum of CAD 100,000.

Time Bar
Any claim arising out of or in connection with the services or any report must be notified in writing within 30 days of discovery and in any event commenced within one year of the date of the report.

Governing Law
These terms are governed by the laws of Ontario and the laws of Canada applicable therein.

Acceptance
Instructing Aegiros, or accepting any attendance, report or invoice, constitutes acceptance of these Standard Terms and Conditions.
